Grievance Processes

Grievances Under the Administrative Grievance Procedure (AGP)

Grievance under the AGP may be requested by an employee, or by a group of employees acting as individuals, for personal relief in a matter of concern or dissatisfaction regarding their employment. The personal relief sought by the employee must be within the authority and control of management officials of the Department. Department Administrative Order (DAO) 202-771, Administrative Grievance Procedure outlines the process and procedures for administrative grievances. This DAO also includes information on Alternative Dispute Resolution.

Grievances Under a Negotiated Grievance Procedure (NGP)

Grievances filed under an applicable NGP includes any complaint by any employee concerning any matter relating to the employment of the employee; by any labor organization concerning any matter relating to the employment of any employee; or by any employee labor organization, or agency concerning the effect or interpretation, or a claim of breach, of a collective bargaining agreement; or any claimed violation, misinterpretation, or misapplication of any law, rule, or regulation affecting conditions of employment. See 5 U.S.C. 7103(a)(9). For more information on the scope of an NGP see Department Administrative Order (DAO) 202-711, Labor-Management Relations.

Bargaining Unit Employees

Bargaining unit employees may not use the AGP unless they are not subject to a NGP, or their NGP specifically excludes the subject from its scope.
