Office of the Chief Counsel for Trade Enforcement and Compliance (OCC-TEC)

The Office of the Chief Counsel for Trade Enforcement & Compliance (CC-TEC) is the principal legal advisor to Enforcement & Compliance (E&C), a unit within the International Trade Administration, regarding legal issues that arise during antidumping (discriminatory pricing) and countervailing duty (foreign government subsidization) administrative proceedings.  CC-TEC also defends E&C’s trade remedy determinations before federal courts (specifically, the Court of International Trade and the Court of Appeals for the Federal Circuit), USMCA panels, and in WTO dispute settlement proceedings.  CC-TEC is also involved in negotiations involving trade remedies, as well as issues related to trade in steel in fora such as the Organization for Economic Cooperation and Development.  The office also provides legal advice to the steel and aluminum import licensing programs and the U.S. Foreign Trade Zones program, among other areas.

CC-TEC’s work is generally divided into two categories – administrative work and litigation. Administrative work includes providing detailed legal advice regarding the complex statutory and regulatory provisions under which antidumping and countervailing duty determinations are made to ensure that they are consistent with law.  Litigation work includes drafting briefs for litigation before U.S. courts, USMCA panels, and panels and the Appellate Body of the WTO, and coordinating with interagency colleagues at the U.S. Department of Justice and Office of the United States Trade Representative, among others.

The office is headed by the Chief Counsel, who is assisted by the Deputy Chief Counsel. The office consists of approximately 40 people, including the Chief Counsel, Deputy Chief Counsel, Assistant Chief Counsels, staff attorneys, and administrative specialists.  Additionally, typically two or more law clerks intern with CCTEC at any given time.
