Grievance Processes

Grievances Under the Administrative Grievance Procedure (AGP)

Grievances under the AGP may be requested by an employee, or by a group of employees acting as individuals, for personal relief in a matter of concern or dissatisfaction regarding their employment. The personal relief sought by the employee must be within the authority and control of management officials of the Department. Department Administrative Order (DAO) 202-771, Administrative Grievance Procedure outlines the process and procedures for administrative grievances. This DAO also includes information on Alternative Dispute Resolution.

Grievances Under a Negotiated Grievance Procedure (NGP)

Grievances filed under an applicable NGP includes any complaint by any employee concerning matters relating to the employment of a bargaining unit employee; interpretation, or a claim of breach of a labor agreement, or a violation, misinterpretation, or misapplication of any law, rule, or regulation concerning employment. See 5 U.S.C. 7103(a)(9).

Bargaining Unit Employees

Bargaining unit employees may not use the AGP unless they are not subject to an NGP, or their NGP specifically excludes the subject from its scope.
