Real Property, Energy, and Environmental Law Division (RPEELD)

The Real Property, Energy, and Environmental Law Division (RPEELD) provides legal expertise and advice to Department of Commerce officials on all aspects of real property transactions.  The Division also handles issues involving energy and environmental law (e.g., compliance, management, climate change, and sustainability); energy contracts (e.g., energy savings performance contracts (ESPCs), utility energy service contracts (UESCs), and utilities); and safety, security, and resiliency matters.  In addition, RPEELD provides counsel on the treatment of historic and cultural properties, and Native American and Tribal matters.

RPEELD’s real estate services cover the development, acquisition, management, utilization and disposal of real property and interests in real property.  Examples of these transactions include leases, use agreements (e.g., permits and licenses), easements, occupancy agreements, and requests for tenant improvements (e.g., reimbursable work authorizations (RWAs)).

The Division represents the Department in all real property matters before the Civilian Board of Contract Appeals, the Government Accountability Office, and in transactions with the General Services Administration and the Department of State.  It serves as the Department liaison with the Department of Justice in litigation before Federal courts.
